A coalition of Democratic-led states is asking the Supreme Court to immediately take up a challenge to Obamacare
, calling on the justices to decide the law's fate well ahead of November's elections.
Attorneys generals from 20 states in a legal brief argued the high court needed to quickly take up the case, contending that prolonged uncertainty over the Affordable Care Act would damage the nation's health care system., but it sent the lawsuit back to a conservative federal judge in Texas who had previously axed the entire law.
likely extending the legal fight over the law well past the election unless the Supreme Court steps in."We’re asking the Supreme Court to swiftly resolve this repeal lawsuit for the sake of saving lives and ending uncertainty in our healthcare system," said California Attorney General Xavier Becerra, who's leading the legal defense of the health care law.
The Supreme Court typically doesn't take cases before lower courts have had a chance to fully review them, but this case's high stakes could prompt the high court to intervene. It takes four justices to agree to hear a case. The Trump administration is supporting the lawsuit, which was brought by more than a dozen GOP-led states almost two years ago. The red states argue that Obamacare was rendered unconstitutional when Congress removed the penalty for not having health insurance in its 2017 tax cut.
