While claiming they want to be transparent with the public, the Davis County Sheriff’s Office refused multiple requests to do an on-camera interview and answer our questions. Instead, they released a Facebook video attacking the media, and making excuses for how this happened.

We can’t show you video evidence of Adam Burdick being booked into the jail that night because Davis County Sheriff Kelly Sparks denied our request for jail surveillance video citing jail intake video is a protected record and not releasable and that if disclosed, would jeopardize the security or safety of a correctional facility. He also cited that it was an open and active investigation and reasonably could be expected to interfere with investigations of the Burdick brothers in his denial.

Then he goes to the men’s restroom where he finds a man wearing a hoodie at the hand dryer. He asks him to come out into the store with him and the man says, “Yeah, absolutely, can I get finished drying my hands?” He says, sure. Davis County jail staff never confirmed his identity - as a result of Davis County Jail officials' failure to verify this information, he impersonated his brother for two and half months until he was released. When the real Andrew Burdick attempted to tell Judge Blaine Rawson, he sentenced the wrong guy and was going to the media, this is what Judge Rawson said to him.I'm not gonna tell you how to operate your case um, but I would advise you not to try and try your case in the media.

I asked him about the booking process in intake at the jail and he divulged specific details that we are unable to confirm the validity of what he said.I do know that the NCIC machine was down that night, referring to the National Crime Information Center which is a criminal records database that allows criminal justice agencies to enter or search for criminal histories. He also said that jail staff did not take his fingerprints.
