PUTRAJAYA, July 6 — The Court of Appeal today allowed a judicial review brought by former DAP member Hew Kuan Yau to quash the Home Minister’s decision to ban the comic bookA three-member panel comprising Justices Datuk Hanipah Farikullah, Datuk P. Ravinthran and Datuk Wira Ahmad Nasfy Yasin allowed Hew’s appeal and overturn the decision of the High Court which had dismissed his judicial review application.
Meanwhile, the panel, led by Justice Hanipah, set aside the High Court order for Hew to pay costs of RM5,000. She also awarded RM1,000 costs to Hew for proceedings in the Court of Appeal. The decision was delivered online via Zoom. On January 6, 2020, the High Court in Kuala Lumpur granted leave to Hew to proceed with his judicial review and on April 26, last year, High Court judge Datuk Noorin Badarudin dismissed his judicial review, prompting him to file an appeal to the Court of Appeal.
