Four days after Daniel Perry was convicted by a jury of murder for killing protester Garrett Foster, his defense team called for a new trial. The motion claims excluded evidence and jury misconduct.
"First, it's alleged that one of the jurors brought outside information about the law concerning self-defense into the jury room in terms of conversation," Cofer recalled from the motion.
The defense also claims an alternate juror participated in deliberations when they were not supposed to. The motion says an alternate juror did not actually speak during deliberations, but did snort, huff, gasp, and make other noises expressing displeasure with certain comments made.On Saturday, Gov. Abbott requested the Board of Pardons and Paroles to look into pardoning Sgt. Daniel Perry. Perry was convicted of murder in the 2020 shooting death of Black Lives Matter protester Garrett Foster.
