Davis requested that the lawsuit be tossed on April 20 and instead filed the paternity suit to seek legal parentage.In the new court filing, Jones’ lawyers said Davis breached her promise outlined in the settlement agreement to not file a paternity lawsuit against Jones.

Davis had received a total of about $3.2 million throughout her life through the agreement, including about $70,000 for a new Range Rover, international trips and four years of tuition at Southern Methodist University, the filing said. She was to receive yearly lump sums when she turned 24, 26 and 28.Jones’ lawyers also argued that Davis did not “timely disaffirm” the settlement agreement — a minor’s contract is voidable and can be ratified once the minor reaches age 18.

“Such lengthy compliance is plainly inconsistent with an intent to avoid the Settlement Agreement and thus constitutes ratification as a matter of law,” the filing said. Davis’ lawsuit is among many issues the Jones family and the Cowboys have faced this offseason. The Jones family’s lives have been in the spotlight following media coverage that detailed Davis’ lawsuit, a multimillion-dollar settlement with the team’s cheerleaders afterby a former Cowboys official and a lawsuit about a videotape of a sexual encounter involving one of Jones’ sons.
