Eight local municipalities already have such protections, but the new ordinance would extend the safeguards county-wide and affirm a tenant’s right to remain in their home if they’re able to pay all past due rent as well as “reasonable” late fees.

Cuyahoga County Council is considering "pay-to-stay" legislation that would protect renters from eviction if they can pay all past due rent, fees and court costs, where applicable. CLEVELAND, Ohio – Cuyahoga County Council is considering adding Pay-to-Stay protections in the county code that would prohibit landlords from evicting tenants for making late rent payments.

“If the tenant tenders all accrued rent and reasonable late fees to the landlord, the landlord shall accept the tendered payment and allow the tenant to maintain the tenancy,” the proposed legislation reads. Councilman Dale Miller, who sponsored the ordinance, said he was motivated by state law that gives landlords the right to take action to evict tenants immediately after a missed payment, regardless of the circumstances or if they’re able to provide the funds soon after. Ohio is one of only five states with such laws.

Molly Martin, a housing rights advocate with NEOCH, said she worries that number may grow as residents continue to recover from the negative impacts of the coronavirus pandemic, including health effects that may limit their ability to work, loss of employment, reduction in income and loss of healthcare coverage. Federal assistance that may have helped residents through those hardships is winding down.

The county’s legislation would not supersede those cities, Martin said, but it would expand the protections to everyone and provide uniform guidance.
