A Malaysian High Court judge ruled that stopping the allocation of funds to the Muar parliamentary constituency is not unlawful or unconstitutional. The judge stated that there is no legal or constitutional provision requiring the Prime Minister and the government to allocate funds to any parliamentary constituency, regardless of their support for the government.
KUALA LUMPUR: Tiada sebarang peruntukan perundangan atau Perlembagaan yang mewajibkan Perdana Menteri dan kerajaan untuk menyalurkan peruntukan ke mana-mana kawasan Parlimen sama ada yang menyokong kerajaan atau sebaliknya.
Pada April lalu, Syed Saddiq dan tiga pengundi di kawasan Parlimen Muar iaitu Najib Abu Nawar, Mohd Bakirudin Abdullah dan Muhamad Fadzly Bisri selaku pemohon, memfailkan permohonan itu dengan menamakan Perdana Menteri Malaysia dan Kerajaan Malaysia sebagai responden pertama dan kedua. “Berdasarkan Aturan 53 Kaedah-Kaedah Mahkamah 2012, permohonan semakan kehakiman hendaklah dibuat serta merta atau dalam tempoh tiga bulan dari tarikh keputusan yang dipertikaikan dibuat. Dalam kes ini, Peguam Kanan Persekutuan menghujahkan bahawa, dakwaan peruntukan untuk Muar terhenti pada pada 19 September 2023.
