Court Dismisses Son's Lawsuit to Exhume Father's Body

The High Court of Seremban has dismissed a lawsuit filed by a son seeking permission to exhume his father's body, who was buried according to Islamic rites seven years ago. The court, presided over by Judicial Commissioner Mohamad Haldar Abdul Aziz, ruled in favor of the Negeri Sembilan State Government and the Negeri Sembilan Islamic Religious Council (MAINS). The plaintiff, Roseli Mahat, had filed the suit claiming her father, Mahat Sulaiman, practiced Hinduism Baba Nyonya and was buried despite his religious beliefs.

SEREMBAN: Mahkamah Tinggi Seremban di sini hari ini membenarkan permohonan Kerajaan Negeri Sembilan dan Majlis Agama Islam Negeri Sembilan untuk membatalkan saman pemula difailkan seorang anak untuk menggali kubur bapanya yang telah dikebumikan secara Islam , tujuh tahun lalu.

Pada 31 Julai 2023, Roseli Mahat, 51, memfailkan saman pemula dengan menamakan lima responden iaitu Kerajaan Malaysia, Jabatan Pendaftaran Negera , Kerajaan Negeri Sembilan, MAINS dan Ketua Polis Negara. “Tuntutan pemohon jelas tidak berasas dan suatu penyalahan proses mahkamah, malah pemohon telah terhalang oleh had masa menurut Seksyen 2 Akta Perlindungan Pihak Berkuasa Awam 1948.

Sementara itu, peguam mewakili MAINS yang diketuai, Datuk Zainul Rijal Abu Bakar berpendapat, kertas kausa yang difailkan plaintif adalah tidak teratur dan perlu dibatalkan. Bagaimanapun, Zainul Rijal berkata, permohonan semakan kehakiman itu telah melampaui masa ditetapkan.
