Pua’s counsel, Tan Cheng Leong, said judge Datuk Rozana Ali Yusof allowed the application on grounds that it is reasonable for the misfeasance suit to be put on hold since Najib has an ongoing criminal case involving 1MDB which is based on similar facts.
“Essentially, Najib had asked for this suit to be put on hold pending the disposal of his ongoing criminal case because there is legal precedence to say that when there is an ongoing trial based on the same facts, the civil case should be stayed,” he said after the matter came up for hearing in chambers today.Counsel Nor Emelia Mohd Iszeham appeared for Najib, while senior federal counsel Habibah Harun acted for the government.
In July 2018, the Court of Appeal dismissed his appeal against the decision and Pua subsequently obtained leave to appeal at the Federal Court.
