WASHINGTON — U.S. Sen. John Cornyn on Tuesday pointed to the landmark 2015 Supreme Court ruling legalizing same-sex marriage as an example of the sort of"court-made law" that he worries Judge Ketanji Brown Jackson might practice if she were confirmed to the high court.
The 14th Amendment prohibits states from depriving “any person of life, liberty, or property, without due process of law.” The Supreme Court in 2015 ruled state laws barring same-sex marriage violated the 14th Amendment. Cornyn said the ruling created a “conflict between what people may believe as a matter of their religious faith, and what the federal government says is the law of the land.”“When there is a right, it means that there are limitations on regulation, even if people are regulating pursuant to their sincerely held religious beliefs,” she said.
