A federal judge in Toledo approved a consent decree Thursday that is seen as a necessary step to reduce the harmful nutrients that lead to toxic algal blooms in Lake Erie.

A TMDL would serve to control the amount of phosphorus entering the watershed from various sources to meet a target level. The litigation that led to the consent decree began in 2017 when the Environmental Law & Policy Center and others sued the U.S. Environmental Protection Agency under the Clean Water Act. The Lucas County Commissioners also joined as plaintiffs.
The program pays farmers to take voluntary steps to better manage their fields and provides money to enhance wetlands in order to reduce the amount of phosphorus that runs off into Lake Erie.
