Former President Donald Trump’s indictment is potentially good for American democracy because it demonstrates that no one is above the law.

As a political science professor, it’s hardly surprising that the indictment of former President Donald Trump has been the subject of myriad conversations with my students during the past week. Watching history unfold in real time will do that.

But for all of their pessimism regarding the flaws of our democratic republic, my students have also expressed optimism that Trump’s indictment is potentially good for American democracy because it demonstrates that no one is above the law. Equal treatment under the law is a basic tenet of our nation’s democratic ideals — one that we historically have not always upheld.

I teach a course on democracy and world politics. The nations that face the most issues with legitimacy, dictatorship and politically motivated arrests typically prosecute too few corrupt officials, not too many. Public confidence in the rule of law in these nations is often viewed with tremendous skepticism. Conversely, mature liberal democracies can, and do, prosecute their former and current leaders.
