Gender-biased misapplication of the law often results in women being arrested for lawfully defending themselves.

Texas Gov. Greg Abbott has pledged to expedite a pardon for U.S. Army Sgt. Daniel Perry, who has been convicted of murder. The governor appears less interested in pardoning women who were convicted of crimes while under the duress of abuse and trafficking.Gov. Gender-biased misapplication of the law often results in women being arrested for lawfully defending themselves and/or a child, when we have waivers for both under subchapter C of the Texas Penal Code. The Lone Star Justice Alliance says incarceration of women here in Texas has skyrocketed since 1980, partly because of these types of arrests.

In a capital murder case, Geraldine Swaim received a life sentence, while the man who killed her abusive husband while Swaim was at work only served four years on a 12-year sentence. There are four other women who were convicted of capital murder, one was sentenced to life without parole, one to 30 years, and two to death row.

We are all socialized into a culture that believes in punishing people for violating the law with incarceration, however, that system is not working to stop violence.
