Carlos Ghosn's bail request has finally been approved—but prosecutors may overturn the decision at the 11th hour

Photographer: Akio Kon/BloombergThe tumultuous times of Carlos Ghosn took an unexpected twist yesterday when the ex-Nissan chairman was granted bail after 100 days in jail. But this is Japan, and just because bail was granted by a Tokyo court for $9 million, does not necessity mean he will actually be released.

In Geneva for the annual motor show, I cornered a Nissan senior executive, who did not wish to be identified, and asked what he thought might happen. Shrugging his shoulders, he said “He has been granted bail but the prosecutors want to keep him in detention and will do everything to keep him there. So at this stage, I can say nothing. We’ll just have to wait and see.”

If Ghosn is released, it will give him more time to confer with his defense team and prepare a comprehensive rebuttal of the crimes of which he has been accused. Given the complicated nature of the accusations against Ghosn which span the globe and nearly two decades of tenure, prosecutor’s and the ex-Nissan chairman’s defense team will need at least six months to prepare their cases meaning that a trial will not happen before summer this year.

Several commentators on Japanese television stressed the severity of the accusations against Ghosn, which centered on many seeing his actions as pure greed. One lawyer explained that the appeal made by prosecutors soon after the bail announcement means that Ghosn most probably won’t be released on Tuesday and may have to remain behind bars.
