California AG Rob Bonta's office announced that he will review San Francisco DA Brooke Jenkins' decision not to charge the security guard who shot and killed 24-year-old Banko Brown outside of a Walgreens store.
“Our office has agreed to review whether the San Francisco District Attorney’s decision not to file charges was an abuse of discretion,” a spokesperson for Bonta first toldIn announcing her decision last week, Jenkins released surveillance footage of the killing. She has said that the guard, Michael Earl-Wayne Anthony, was acting in self-defense when he shot Brown — a determination that has been disputed by members of the public, as well as elected officials in the city.
After a speech in which District 4 Supervisor Joel Engardio said, “It was personally hard for me to understand the district attorney’s interpretation of the video” that showed the shooting, District 11 Supervisor Ahsha Safai alerted the board of Bonta’s decision, and the resolution passed without further discussion from the full board.
Peskin told SFGATE last week that the video was worrying, and he said he wanted another prosecutor to review it. “It shows me the security guard punched Mr. Brown and had no trouble wrestling him to the ground and no trouble subduing him,” he said. “In modern American policing, we are taught about de-escalation situations, and we saw none of that here. Mr. Brown was clearly backing away from the security guard when he was shot.”
As for Bonta’s decision to review the SF DA’s determination, it is uncommon for state and federal attorneys general to take up cases that local officials have already made a decision on. However, Bonta said a few days ago he’s “
