A bill intended to prohibit state and local police from enforcing presidential executive orders on gun control won approval today in an Alabama House committee.

The House Public Safety Committee approved the bill on a 9-4 vote, with Republicans supporting it and Democrats opposed. .Rep. Chris England, D-Tuscaloosa, asked Standridge whether states can pick what federal orders they choose to follow. England said the bill would put officers in a difficult position, possibly at odds with their supervisors, and could get them fired.

The proposal is not brand new. Republican lawmakers proposed similar bills last year after President Biden took office.Rep. TaShina Morris, D-Montgomery, said the Legislature should not try override presidential orders any more than it would tolerate a city trying to override a state law. “We’re not saying he’s going to do this, we’re not saying the next president’s going to do it,” Estes said. “My understanding is we’re just saying if that attempt should be made regardless of the president, regardless of the party in power at the time, we don’t believe that’s enforceable under the Constitution. And therefore we would not recognize that.”
