A 36-year-old pork seller was jailed 12 months and fined RM2,000 or another six months, Friday, for assaulting his wife last week.
Andy Faziero Albert pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence to the 27-year-old housewife at 11pm on June 15 at the parking lot of a rented house at Kg Kobusak, Penampang.According to the prosecution, prior to the incident, the couple were involved in a heated argument. Andy then lost control and hit his wife’s head repeatedly until it bleeds.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.
