An 8th Ohio District Court of Appeals panel found that Judge Shirley Strickland Saffold denied Ricardo Vega III a fair sentencing when she ordered him to spend 17 months in prison on a charge that carried the presumption of probation.CLEVELAND, Ohio -- An appeals court says a Cuyahoga County Common Pleas judge showed bias by sending a man to prison on a low-level felony after he was acquitted of a separate, more serious charge.
Judges Mary Eileen Kilbane, Eileen T. Gallagher and Mary J. Boyle overturned Vega’s prison sentence and ordered the case to be assigned to a different judge to conduct a new sentencing hearing. Saffold issued a one-sentence statement through her bailiff, Larry Wallace. It referred to Ohio Supreme Court Chief Justice Sharon Kennedy’s decision earlier this year to deny Sidoti’s requests to disqualify her from the case.Court documents, however, show that Kennedy denied Sidoti’s request in Vega’s case because it came after the sentencing and, therefore, there was no court action for Saffold to preside over.
When Saffold announced a month later that she was sentencing Vega to 17 months in prison on the gun charge, Sidoti objected and repeatedly reminded Saffold that he had no criminal record. Saffold pointed to a juvenile case in which Vega was charged with burglary but had the charge dismissed after completing a diversion program.
