Anthony Albanese has left the door open to legislating an Indigenous Voice to parliament, even if the proposal is defeated at a referendum.

Mr Albanese rejected claims by former High Court judge Ian Callinan that the Voice could lead to a “decade or more of constitutional and administrative law litigation”, maintaining the Voice would be purely an advisory body on policies affecting Indigenous Australians.“We have had [other] former High Court judges writing opinion pieces after opinion pieces, making it very clear that this issue will not lead to a legal minefield,” he said.
“You could come up with, you know, 50 theoretical questions about a whole range of issues in order to undermine what is a very simple principle,” Mr Albanese said. But pressed during his interview with Fordham, he did not rule out creating a Voice anyway by passing legislation if the referendum failed to win a majority of voters in a majority of states.
