In a public statement released late Thursday Alabama Supreme Court Chief Justice Tom Parker, who is chair of the commission, said this decision was made due to the results of the most recent study of caseloads - the number of cases a judge is assigned. That study, released in January 2020, shows there was an excess of 7.98 circuit judges in the 10th Judicial Circuit and a deficit of 3.
Sen. Roger Smitherman, D-Birmingham, was present in the meeting and blamed faulty data and an unwillingness to move surplus state funds for the reallocation. Smitherman said numbers for the workloads of each county were skewed in study findings and stated that in Jefferson multiple charges can be filed for the same person under one “case number” but in other counties such as Madison these charges are all filed as separate cases therefore giving the illusion of a heavier workload.
Smitherman gave credit to Parker for aggressively campaigning for the necessary funding to obtain more judges. But he also expressed concerns over motivations of race and politics, whether conscious or not, and said he felt this decision was a punitive action toward a Democrat-heavy Jefferson County by an appointed board of mostly Republican officials.
