– Two men who said they witnessed the murder of 11-year-old Josue Flores both testified in court on Wednesday.
Robert Figueroa and Joshua Hubbard testified that they heard a noise that drew their attention onto the porch of their friend’s house. “I saw a guy and a kid. The kid was struggling. It was the guy who walked past us. It looked like he was roughing him, a punching motion. He tossed him, just took off and ran,” Hubbard testified.“He fell on his stomach and he had his hand wrapped around his gut. I thought he’d been winded. I said, ‘Hey kid, are you alright?’ I didn’t get a response. I saw blood,” Figueroa said.
In his 911 call, which prosecutors played in court for the jury, Figueroa said: ” A kid got stabbed. He’s in the street. A man just ran up and stabbed this kid, stabbed him in his arm and abdomen.”The judge presiding over the Andre Jackson murder trial decided that the testimony in the case will continue.On Tuesday, the defense made the claim that they did not receive a piece of evidence, specifically details of what was recovered following the execution of a search warrant.
Judge Collins ruled that the trial would continue, but that one of the witnesses, Jimmy Turpin Lt. with the Special Crime Unit, would not be able to discuss the process to locate the defendant at the Salvation Army unless she approved the context in which the question is raised.
